EFFECTIVE IMPLENTATION OF THE CONSTITUTIONAL PROVISIONS ON LAND USE PLANNING IN KENYA

Abstract

Land is an important factor of production. It contains an array of natural capital stocks such as minerals and raw materials for human use. It is also an important object for agricultural and land use. Since land is such an essential factor of production there is need to regulate its use to ensure ease of access and sustainability.
Kenya’s constitutional provisions on land and the environment require that land be used in a sustainable manner. Effective land use planning is important in attaining sustainability. Indeed the National Land Policy recognizes land use planning is essential to efficient and sustainable utilization and management of land and land based resources. However despite the fact the constitutional provisions on land require that there be sustainable land use, the problem of ineffective implementation of land use plans continues to affect the country.
