Realizing the Right of Access to Information: What Should Stakeholders be on the Look Out For?

Abstract

 

Drawing on fieldwork this piece evaluates the factors that stakeholders need to take on board in the quest to observe, respect, promote, protect and fulfill the right to receive information that is held by the state and its agencies. The article, which uses Kenya as a case study, demonstrates that the public faces several difficulties in the quest to enjoy this fundamental right, including prohibitive requirements for disclosure, lack of information, and the culture of secrecy as well as absence of criteria and an appeals framework. It is in the interest of stakeholders to take steps towards meeting these concerns. Accordingly, the chapter makes specific legal and policy recommendations that could alleviate these obstacles.
